1. Agreement
These Terms govern your use of EightOS - the web dashboard at eightos.xyz, the API at api.eightos.xyz, the MCP server endpoint, the connect SDK, and the EightOSdesktop application (together, the “Service”), operated by Codiste (“we”, “us”).
By creating an account or using the Service you accept these Terms. If you accept on behalf of a company, you confirm you are authorised to bind it, and “you” means that company.
Our Privacy Policy forms part of these Terms.
2. What the Service does
EightOS connects AI agents to your business systems. It provides:
- Unified API. One normalised schema across many providers.
- MCP server. Through which AI agents discover and execute tools.
- Connectors. To third-party systems you authorise.
- Company Brain. A knowledge graph built from sources you select, queried by your agents.
- Workspace chat and a playground. For interacting with your connected systems.
- Scheduled tasks, webhooks and delivery. To channels you configure.
- Bring Your Own LLM and Bring Your Own MCP. Extension points for your own model keys and external MCP servers.
We may change, add or remove features. We will give at least 30days’ notice before removing or materially degrading a feature you depend on.
3. Accounts
You must be at least 18 years old and legally able to enter a contract. You must give accurate registration details and keep them current. You are responsible for everything that happens under your account, including actions taken by your team members, your API keys and your AI agents.
Keep your credentials secure. Tell us immediately at support@eightos.xyz if you suspect unauthorised access.
4. Your data and your content
You own your data. Records in your connected systems, documents you upload, instructions your team records, and everything derived from them in Company Brain remain yours.
You grant us a limited, non-exclusive licence to host, copy, transmit, index, embed and display that content solely to provide and support the Service to you, and to the extent necessary to route it to the sub-processors described in the Privacy Policy. This licence ends when you delete the content or close your account.
You are responsible for the content you route through the Service. You confirm that you have the right to connect each system you connect, that you have any consents required to process the personal data inside it, and that doing so does not breach your agreements with those providers or with the people the data concerns.
5. Connected third-party services
When you connect a third-party system you authorise us to access it within the scopes you grant. Your use of those systems stays governed by your agreement with their providers. We are not responsible for their availability, accuracy, changes to their APIs, their rate limits, or their suspension of your account. If a provider changes or withdraws its API, the corresponding EightOS functionality may change or stop working.
You may revoke a connection at any time from the dashboard.
6. AI features and their limits
Company Brain, workspace chat and agent tooling use large language models. You should understand:
- Output can be wrong. Model output may be inaccurate, incomplete, out of date or misleading. It is not professional, legal, financial, medical or other regulated advice.
- Review before you rely. Do not act on AI output in any consequential matter without human review. This matters most where an agent performs a write into one of your systems.
- Agents act with your authority. Actions your agents take through the Service are your actions. Use the permission controls, environments and grants we provide to bound what they can do. We are not liable for the consequences of actions you authorised an agent to perform.
- Retrieval is not exhaustive. Company Brain returns what it has ingested and what its search surfaces. Absence of a result is not evidence of absence.
7. Acceptable use
You must not:
- Break the law. Use the Service unlawfully, or to process data you have no right to process.
- Connect without authority. Connect a system you are not authorised to connect.
- Probe the Service. Attempt to access another organisation’s data, or probe, scan or test the security of the Service except under a written authorisation from us.
- Reverse engineer. Decompile or attempt to extract source code, except where that restriction is unenforceable by law.
- Circumvent limits. Rate limits, credit limits, permission controls or usage metering.
- Resell. Provide the Service to third parties except through the sub-account and end-user features we provide for that purpose.
- Distribute harmful content. Use the Service to generate or distribute malware, spam, or content that is unlawful, harassing or infringing.
- Build a competing product. Using our non-public interfaces or performance data.
- Degrade the Service. Overload it, or use it in a way that degrades it for others.
8. Plans, credits and payment
The Service is offered on plans with differing limits. Usage consumes credits, metered per API call, tool execution and AI operation, and recorded in your usage and cost ledger.
Fees are as shown at checkout or in your order form.
9. Rate limits and fair use
We apply rate limits per plan and may apply additional protections against abuse. We may throttle or temporarily suspend activity that threatens the stability of the Service, and will tell you when we do.
10. Security responsibilities
We secure the platform as described in the Privacy Policy. You are responsible for:
- API keys. Keeping them secret and rotating them when a team member leaves.
- Permission configuration. Grants, departments and environments set appropriately.
- Agent scope. Reviewing what your agents are permitted to do.
- Your own keys and servers. The security of any model provider key or external MCP server you supply under Bring Your Own LLM or Bring Your Own MCP.
Content you route to an external MCP server or your own model provider leaves our control, and we are not responsible for how that party handles it.
11. Intellectual property
The Service - its software, interfaces, documentation, connector manifests, and branding - is ours and our licensors’. These Terms grant you a right to use it, not to own it. All rights not expressly granted are reserved.
Feedback you send us may be used freely and without obligation to you.
12. Confidentiality
Each party will protect the other’s non-public information with at least reasonable care and use it only for the purposes of these Terms. This does not apply to information that is public, independently developed, or lawfully received from a third party, or that must be disclosed by law.
13. Beta and early-access features
Features marked beta, preview, experimental or early access are provided as-is, may change or be withdrawn at any time, may be unstable, and are excluded from any service commitment.
14. Availability
We aim for high availability but do not currently offer a contractual uptime commitment on self-service plans.
We may take the Service down for maintenance, and will give notice for planned maintenance where we can.
15. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or that AI output will be accurate.
16. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data.
Our total aggregate liability arising out of or relating to these Terms will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.
Nothing here limits liability that cannot be limited by law.
17. Indemnity
You will defend and indemnify us against third-party claims arising from your content, your use of the Service in breach of these Terms, or your violation of law or of a third party’s rights.
18. Suspension and termination
You may stop using the Service and close your account at any time.
We may suspend or terminate your access if you materially breach these Terms, if your use threatens the Service or another customer, if required by law, or for non-payment - with notice and an opportunity to cure where the circumstances allow.
On termination your right to use the Service ends. Sections that by their nature survive termination do survive it, including 4 (ownership), 11, 12, 15, 16, 17 and 19.
19. Changes to these Terms
We may update these Terms. We will post the revision here and update the date. For material changes we will notify account administrators by email at least 30 days in advance. Continuing to use the Service after they take effect means you accept them.
20. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of Ahmedabad, Gujarat, India have exclusive jurisdiction.
21. General
These Terms, with the Privacy Policy and any order form, are the entire agreement between us. If a provision is unenforceable, the rest survives. Failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor in a merger or sale.
